Company Policy and Disclaimer
The information on this page is subject to change without prior notice and will serve as the final policy above all others. This policy will be considered part of any Ebay auction it is linked to and not subject to question from buyer.
General Information
- Buyer is responsible for any sales tax due on this purchase and/or any royalty due on any copywrited material used in development.
- Buyer is solely responsible for and answerable to any laws pertaining to legal backup copies of their legal video property.
- Buyer must send tapes, disks, or reels within 30 days or forfeit any payment made.
- Transfers are NTSC only, no PAL.
- Circumventing Ebay and Paypal to avoid fees will result in the forfeiture of your property till proper purchase and payment methods have been satisfied as described here.
- Tape transfers are not tape restorations.
- Alternate transfer equipment and methods may be used to transfer tapes and can result in different menu styles and looks of DVD menus.
- StewartM Transfers reserves the right to choose the method of tape transfer.
- Tapes not clearly labeled will be labeled in numerical order.
- Slide images may include rounded corners or edges to include as much of your image as practical.
- Slides will be scanned at the rate of 250-300 per day.
- Buying from or selling to this user allows this seller/buyer free use of your email address.
- DVD copies are one copy per one DVD not one copy of all DVD's.
- Some tapes may not be rewound to reduce wear on our equipment.
- We do not keep/retain copies of your tapes, photos, slides, or discs.
- We do not clean your slides before scanning. Air dusting will NOT remove all visible marks.
Feedback/Bidding
- As outlined by eBay, "Your bid is a contract - Place a bid only if you're serious about buying the item. If you are the winning bidder, you will enter into a legally binding contract to purchase the item from the seller." Unpaid items/auctions will be reported.
- By placing your bid you agree that you have read, understand and accept all content in this auction (i.e., Shipping, Payments, Terms & Conditions, Special Issues, Warranty & Return, and Feedback policies.) as well as those of StewartM.Com
- All transfer and other purchases must be made through Ebay.
- Seller/buyer feedback will only be left in response to yours.
Item/Transfer Sale/Returns
- Item(s) is/are used and known to be in working order and is/are sold as is.
- Returns can/will not be accepted on items.
- Item(s)/services must be paid for WITHIN FIVE (5) DAYS of purchase. If not, an unpaid item report will be filed.
- You must contact seller for non-operational transfer replacement before returning your transfer(s).
- All original transfer disks and cases must be returned intact within 60 days of the original sale to receive your replacement.
Shipping
- Item(s) only shipped to the lower US 48.
- We do not ship to AK, HI or PR.
- Item(s) are shipped/received USPS mail only to our PO box. No FedEx or UPS.
- Orders are shipped media mail 2-9 day service.
- Items will be shipped to your Paypal address only.
- No local pickup or delivery.
Payments/Refunds
- All payments must be made through Paypal.
- Payments by check of any type, M.O. of any type, or cashiers check of any type, will delay shipment by 24 hours till cleared by our local bank.
- This seller reserves the right to refuse your business and refund your payment minus fees at any time for any reason.
- No refund will be given on tapes that arrive in poor condition, play poorly, track poorly, or may be blank or broken. They will be processed like all others and all charges will apply.
- S/H reimbursement will not exceed five dollars.
- All refunds will be issued through Paypal only regardless of payment method. If you do not have a Paypal account, you will not be issued a refund until you do. No exceptions.
- Refunds must be processed within 60 days of purchase.
Email/Messages/Private Auctions
- Private auction will run for 3 days only unless otherwise requested.
- All emails sent to and from StewartM.com are the property of StewartM.com and may be posted without prior notice or consent.
- All messages sent to and from StewartM.com or Ebay user albert41s9 through the Ebay messaging system are the property of StewartM.com and may be posted without prior notice or consent.
Payments
- Your private payment auctions will be assigned a number in lieu of your Ebay user-id.
- Quote prices may be rounded up or down to the nearest dollar increment when payments are made.
- Agreeing to make payments for any requested service is considered the purchase of a total auction for that service.
- Payments are required to be made through Paypal only. No checks or money orders for payments.
- All payments must be made in full as part of the payment agreement.
- Stopping payments before being paid in full will result in an unpaid item report being filed.
- All payments must be made in full before your services will begin.
- Failure to make your payments will result in the forfeiture of any previous payment(s) made.
- Buyer must send tapes, disks, or reels within 30 days of final payment or forfeit any payment made.
- Your password to your private credit page will be sent to your Ebay user ID through the Ebay messaging system only.
- Private credit pages will be updated 24-72 hours after your payment is made.
- Private credit pages will removed when all payments are made, services are completed, or at the discresion of StewartM.com.
Copyrighted Material
- The copyright Office of the Library of Congress concerning non-infringing uses as defined in the Digital Millennium Copyright Act. Provisions of the DMCA (17 U.S.C. 1201(a) are interpreted such that rights of fair use are restricted, and lend themselves to censorship of information that does not infringe upon an author's copyright. It is legal for one to copy a video tape or DVD for one's own use, even when the copyrighted material on the tape is not that person's legal property. The individual has paid for the product and is entitled to do with it what he pleases aside from illegally copying the work for sale or distribution. Existing laws already make copying media without permission unlawful, and no further protection is needed, unless it can be done with absolutely no interference with a user’s right to play back and make archival backup copies of the media.
MAGNETIC TAPE INFORMATION
(Beta, VHS, VHS-C, 8mm, Hi8, Mini/V8, etc.)
Your magnetic tape may fall under the following:
- Magnetic tape is/was only under warranty for a 3-5 year lifespan, 5-10 if kept under the ideal conditions of temperature and humidity. (See manufacturers specifications & warranty.)
- Magnetic tape older than 5-10 years or those stored near other electronic equipment (magnetic fields) may not play in all players, may not be playable at all or may be erased.
- Deteriorated tape may show signs of poor tracking and/or static in playback mode.
- Movie playback may improve towards the end of the tape if it was rewound and protected by the outer layers of the tape.
- Mold and mineral deposits may form on tape if not kept in proper storage and will significantly degrade playback or render the tape unplayable.
- Starting and stopping your recordings or playbacks at multiple points on the tape may alter the proper tracking during playback and may result in poor or deteriorated playback.
- Time is NOT a friend to magnetic tape, in some cases it may have run out.
